Supreme Court directed the Union Government to
establish Civil Services Boards in order to control appointments, posting and
transfers in Civil Service. The Union Govt. have to take decision within three
months. Separate boards should be created in Centre and States under the
chairmanship of Cabinet Secretary and
Chief Secretaries respectively. Also the duration of appointment to a post
should be decided prior to the appointment, preferably three years. This will
reduce the corruption and lack of governance in administration. Civil Servants
need not obey vocal instructions given by Ministers and other politicians.
There should be written orders for an action; in both the Ministers to Civil
Servants and Civil Servants to Sub-ordinates. Court also noted that such an
initiative is necessary in the context of existing right to information act.
Verdict is given in a Public Interest Litigation (PLI) filed by the former
Cabinet Secretary Sri. T.R.S.Subramahnyam and his colleagues. They argued for a
legal action against mass transfers
after election. The landmark verdict is delivered by a bench consisting of
Justice: K.S.Radhakrishnan.
